Terms and Conditions:
Member agrees:
- To install the Marathon Water Heater in a permanent occupied dwelling such where it will be used at least 9 months out of the year on the SWCE system.
- To stay on Marathon Water Heater Program for a minimum of seven years. Member will notify SWCE and reimburse SWCE for all costs of the Marathon Water Heater if for any reason it is not used for water heating during the seven-year period. No reimbursement is necessary if the Member moves and the New Member continues to use the Marathon Water Heater. If the water heater is removed for any reason, it is the Member’s responsibility to remove all exposed wiring and conduit according to the National Electrical Code.
- To make the necessary arrangements to pick up the Marathon Water Heater and receiver.
- To have the Marathon Water Heater installed, operating, and the ability for SWCE to control within sixty days of receiving.
- To allow SWCE to control for up to eight hours continuous if on the Peak Shaving Water Heating Program or up to sixteen hours continuous if on the Storage Water Heating Program.
- To pay for all plumbing and electrical installation costs associated with the Marathon Water Heater and Receiver.
- To be responsible for removal and proper disposal of existing water heater. Consult MPCA offices for details on their web site at www.pca.state.mn.us or phone (651) 297-8681 or (800) 657-3724.
- To have the Receiver located on an exterior side of an outside wall, a minimum of four feet from grade level, (Not to be enclosed). Should it become necessary to move the Receiver, it will be at the member’s expense.
- To allow SWCE access to periodically check the Marathon Water Heater and the control system for proper operation.
- To notify SWCE if seals need to be broken in order to perform electrical maintenance or troubleshooting of the Marathon Water Heater Circuit.
SWCE agrees:
- To furnish a Marathon Water Heater to the Member free of charge provided it will be controlled in accordance with SWCE load management guidelines.
- Issue a monthly credit to the member’s account (except Dual Fuel Members) on months where 400 kWh or more are metered.
- To only remove the receiver upon termination of this agreement.
- To periodically check the Receiver for proper operation.
Warranty:
- Per Marathon Warranty Statement enclosed with each Water Heater.
Indemnity & Hold Harmless Agreement:
Member hereby agrees to indemnify and hold SWCE harmless from any and all claims, complaints, lawsuits, arbitration proceedings, administrative proceedings, warranty disputes and any other adversary matters relating in any way whatsoever to SWCE’s performance or non performance under or pursuant to this contract, or related to SWCE’s actions or inactions at the job site. This provision shall protect SWCE from any and all personal injury, workers’ compensation, wrongful death, unemployment, discrimination, breach of warranty, negligence, strict liability, breach of contract, and any other claim arising from the performance or nonperformance by SWCE and/or any person or firm acting at SWCE’s request or on SWCE’s behalf, including but not limited to SWCE’s employees.
